Election of All India Goaar Rajput Sabha Phillaur,Punjab, July 8th, 2007 ((Special Reporter Harpreet Singh Rupana): For creating unity among the different names of Goaars, a meeting of All India Goaar Rajpoot Bhaichara for election of All India Goaar Rajpot Sabha was called at Historic city of Punjab i.e. Phillaur on 8th July, 2007.
Unanimously S. Inder Singh Valjot LL.B. (Advocate) was elected as President and Sh. Harbans Lal Lalka AMIE (SDO) as Secretary General.
S. Jagir Singh Khalsa, S. Sham Singh Muchhal, Sh. Sunder Lal Muchhal, S.Kanail Singh Dyalpuri, S. Karnail Singh Sailkiyana, S. Mohinder Singh Rakhra Has been elected as members.
Election Panal Of S. Darshan Singh Lehal, S. Surjit Singh Samana, Master Harbans Singh Morron, S. Sham Singh Muchhal, Sh. Sunder Lal Muchhal, S. Charan Singh Naik (Uttaranchal) was unanimously formed in the beginning of the meeting.
The Election Panal also authorised the President and Secretary General to elect the other office bearers and members within the constitution of AIGRS.
The meeting among others was attended by S. Kubeep Singh Kadiana , Sh. Bira Ram Valjot Municipal Councillor Phagwara, Sukhdev Singh Patwari, Avtar Singh Patwari, Ichhar Ram Valjot Ludhiana, Surjit Singh Vadala, Er. Kashmeer Singh, Hardarshan Singh Amritsar, Dr. Darshan Singh Panj Grain, Ritesh Kamal and other prominent persons of Other Goaar Rajpoot Categories i.e. S. Charan Singh Naik Uttaranchal (Banjara), S. Sewa Singh Rathor Patiala and S. Satnam Singh Baagi (Sirkiband ).
All the present member shown unity in elecion process.
Constitution All India Goaar Rajpoot Sabha (A.I.G.R.S.) Preamble :- For creating common brotherhood, common awareness, social economic and educational progress, social reform, general welfare and for solving common problems being faced by GOAAR RAJPOOT SAMAJ living through out INDIA ( Which is being Known with different names in different parts of INDIA) This "GOAAR RAJPOOT SABHA ” is being formed which will be known as "ALL INDIA GOAAR RAJPOOT SABHA’ later on this will be referred as 'SABHA'.
Article-1 Objectives:- A.I.G.R.S. will work at all India level to fulfill the following objectives :-
1. To establish branches of A.I.G.R.S. in different states & districts. 2. To discover the history of G.R.S., its publication for distribution among the people. 3. To think over the problems of G.R.S. and to make efforts to solve them. 4. To bring about common awareness in G.R.S. 5. Explain of education in G.R.S. & to make efforts to provide other education facility & to help the talented children economically in need. 6. To obtain immoveable property, its possession & sale etc. 7. To prepare & propagate the biography of great personalities related to G.R.S. 8. To provide business information to the people of G.R.S. 9. To help G.R.S. to get facilities, provided by the Govt. & also to help in getting more facilities from the Govt. & introducing them to the Society. 10. To make efforts for the development of literary, cultural, social & economic aspects of G.R.S. 11. To honour that individual who done any prestigious work for G.R.S. 12. To honour any individual or institution that works for G.R.S. Article -2 Membership: 1. Every person will be eligible for the membership of the G.R.S. who is of 18 years or more and is a citizen of India, and who believes in the policies & objectives of the Sabha, obeys the constitution & gives, time to time fixed fee to the sabha, accepts the sabha’s decision and who is not a bankrupt, mentally retard, and who has not been punished for normal turpitude. 2. For this purpose he/she will request to the national leader in a fixed Performa (Anaxure-1). He /She will request alongwith the recommendation of two primary members of the sabha. 3. From the District level to higher level sabha will have the right to accept the membership form, for primary member /life primary member, filled on recommended Performa. Membership will be considered only after the approval of National president as per constitution of sabha. 4. No body can be primary members at two places at one time. 5. If any member of sabha with valid reasons wants to change /transfer his/her membership to any other district, he will request to the national president, through concerned unit. The transfer of membership from one unit to another will be considered only after the approval by the national president. 6. Primary Member :- The person who fills to fixed performa with membership fees Rs. 100/- & if his/her membership is accepted then he/she will be counted as the primary member of the sabha. 7. Founder Member :- Founder member will be considered as the voter primary member for life . Initially the status of these members will be of national delegate and these delegates will constitute the first National Sabha . This national sabha /national executive after making members as per constitution will hold election of District Sabha / State Sabha / and National Sabha within two years. The persons entered in the attached list ( Annexure -2) are Founder members of this sabha. 8. Voter Primary Member :- The voter primary member will be that member who’s name is enlisted in the voter list . For this it is essential that he/she must have paid monthly fees of Rs. 20/- (Rs. Twenty Only) or Rs. 720/-(Rs. Seven hundred twenty only ) for three years, within the due date. In delegate election only those primary voter member will have the right to participate whose name is enlisted in the voter list. 9. Life Members : - Any individual after filling the fixed Performa with Rs. 100/- (Rs. Hundred only) membership fees & Rs. 2000/-(Rs. Two thousand only) fee for life can become the life voter primary member . He/She needs not to give monthly fee. If he/she is unable to give full amount of Rs. 2000/-( Rs. Two thousand only ) he/ she can deposit in installments within two years. He/She will be get the right to participate in election process after depositing the full amount of Rs. 2000/-( Rs. Two thousand only). If the above referred life member ( who has made request for life member ) fails to deposit request Rs. 2000/- (Rs. Two thousand only) within two years, then he/she will be considered as just primary member & he/she will not be eligible to participate in any election process. Article – 3 Resignation from Sabha Membership / Resignation from membership That individual will not be the member of sabha if :-
1. He/she is dead or lost his/her mental balance. 2. He/she gives his/her resignation from the membership & his/her resignation has been accepted. 3. Declared accused of moral terpitute. 4. He/she does not pay fee according the norms fixed by the sabha. 5. He/She works against the objectives of the sabha. 6. His/her membership has been cancelled according to the norms. Article - 4 Duties of the Members of the sabha :- Duties of the members of sabha will be as follows :-
1. To be faithful towards sabha. 2. To work for the fulfillment of objectives of sabha. 3. To maintain the discipline of the sabha. 4. Not to do any such task which endanger the unity of the sabha. 5. Obey the orders of special committee of sabha. 6. Always protect the interest of sabha. Article – 5 Rights of the sabha Members :- 1. To right to participate in election according to the constitution to elect & to be elected the delegate of the sabha. 2. To introduce proposal for the fulfillment of objectives of the sabha. 3. To advise & to criticize constructively the works done by the sabha. 4. To be present in person or by representative to place his views before the disciplinary committee . When the sabha or any committee of the sabha or nominated person by the sabha started the disciplinary action against that member. Article - 6 Record of sabha Membership :- The record of the sabha membership will be kept according to the instructions of National Sabha.
Article – 7 Features 1. This sabha is a social organization. It is non-political & secular. Sabha will not be associated to any political party or religious organization. 2. Each member / office bearer of the sabha has right to have relations with any political party or religious organization in personal capacity. 3. No member /office bearer of the sabha can use the sabha name for any political party or religious organization. Article - 8 Head Office of the Sabha 1. For the time being the head office of the sabha will be at __________. Office can be shifted to another place if needed. 2. At State level & District level sabha , can have office in their suitable territory with the permission of National president. Article - 9 Organization Units of sabha will be three leveled means the lowest level sabha unit will be at District level and above the State level unit & national level unit. All units will be under National level. Units at District level will be under the respective State level.
Article -10 Formation of District Sabha (D.S.) District Sabha will be elected through delegate system.
1. One District delegate will be elected after 25 primary voter members. So in this way elected delegates will constitute the District Sabha (D.S.) & they will be called as District Delegates. It is necessary that both primary voter member & District delegate should be of the concerned District & their names should appear in voter list of that district . There must be at least 11 delegates to constitute district sabha. If it is not possible then two or more District can form one District Sabha. 2. If State sabha feels necessary, State Sabha can form District sabha with the consent of National president, having at least 11 voter primary members whose names are in the voter list of that district . (In these circumstances constituted sabha in the district will have all the rights as the other District sabhas, but the selection of delegates for the upper sabha will be according to the fixed norms. In such situation only voter primary member will elect the executive. Article -11 Formation of State Sabha ( S.S.) 1. Each district sabha will elect one delegate after 25 elected district delegates and recommend the delegate for state Sabha . Delegates so elected by district sabhas will form the State sabha & they will be called as State delegates. It is pre condition that the name of the delegate to be elected for the State sabha is enlisted in the district voter list of concerned district . 2. District sabha president & General Secretary will be Ex officio delegates of State Sabha . Article – 12 Formation of National Sabha (N.S.) 1. Each State Sabha will send one delegate after 50 elected State delegates for National Sabha. Delegates sent by state sabha will form National Sabha collectively & they will be called national delegates. It is precondition that the name of the delegates to be elected by State sabha is enlisted in the voter list of that state. 2. No individual can be the delegate of both State sabha & National Sabha at the same time. 3. State Sabha President & General Secretary will be ex officio delegates due to their position. Article – 13 Voter List According to the norms those voter primary members who are eligible to vote, cast their vote. Their voter list will be prepared by National sabha . Copies of these voter lists will be kept available in the concerned district, State & in National Sabha office.
Article – 14 Nomination of the Delegates :- District, State & National sabha President respectively can nominate maximum 5% delegates of their elected delegates of their sabha. While nominating the delegate, the president will keep in mind that the services of person to be nominated are essentially needed to that particular sabha or the sabha will be benefits by nominating him/her or the nominated person, he/she is expert in particular aspect of life/field and due to his/her this quality Goaar Rajpoot Samaj or Goaar rajpoot sabha will be benefited .It is condition for the delegate nominated that He/she must be primary member of any district of the sabha. The nominated delegates will not have the right to vote in the election of delegates for the upper level sabha.
Article – 15 (A) Executive committee at District Level :- For day to day work of the District Sabha there will be an executive committee (C.E.) for district sabha. The president & other office bearer will be elected by the delegates of district sabha with a simple majority. It is condition president that to be elected as executive members, he/she should be voter primary member of that district. The office bearer of District Sabha executive can be as follows :-
1. President - 1 2. Vice-President - 1 3. General Secretary - 1 4. Finance Secretary - 1 5. Administrative Secretary - 1 6. Propaganda Secretary - 1 7. Executive Members - 3 (B) District sabha can dismiss any office bearer / executive member with simple majority.
Article – 16 Executive committee at State Level :- (A) There will be an executive committee for day to day work of State sabha. The elected delegates at State level will elect the president & other office bearers with simple majority. To be the executive member it is necessary that he/she should be voter primary member of any district of concerned State. The office bearers / executive members of State executive committee can be as follows: -
1. President - 1 2. Vice-President - 1 3. General Secretary - 1 4. Finance Secretary - 1 5. Administrative Secretary - 1 6. Propaganda Secretary - 1 7. Executive Members - 5 (B) State level sabha can dismiss any office bearer / executive member with simple majority.
Article – 17 Executive committee at Nationals level :- There will be executive committee for day to day work of national sabha. The elected delegates at national level will elect the president & other office bearers with simple majority. To be the office bearer / executive member, it is necessary that he/she should be voter primary member of district in country National executive committee can be as follows :-
1. President - 1 2. Senior Vice-President - 1 3. Vice President - 3 4. Secretary General - 1 5. Finance Secretary - 1 6. Administrative Secretary - 1 7. General Secretary - 3 8. Propaganda Secretary - 3 9. Executive Members - 7 (B) National level sabha can dismiss any any office bearer / executive member with simple majority.
Article – 18 Selction of new office bearer in case of the vacant post :- 1. If the president of the sabha of any level gives his/her resignation & it has been accepted, or he/she has expired, or has been dismissed from his/her prsidentship, or he/she is incapable in fulfilling his/her duties them in this condition the next senior office bearer of executive committee as per above referred order will hold the president office temporarily till the new president is not elected by the concerned sabha. 2. The selection of the new president will be done in the forth coming meeting of the sabha. 3. If any office of the executive committee except president gets vacant by any reason then the resident can give the work of that office to any office bearer/member of executive committee till the next of forth coming election. Article - 19 About the Resignation by the President :- 1. The district president level will submit his/her resignation to the state president ,and the State president will submit his /her resignation to the national president. They have rights to accept or to reject the resignation. In case of resignation, necessary action to appoint the next president will be started by the person who gets the resignation. 2. President of national sabha will submit his/her resignation to the executive committee. It will decided by the executive committee whether to accept the resignation or not. 3. Beside the president of any sabha the other executive members/office bearers will give their resignation to the president of the concerned sabha. On acceptance the resignation will be considered accepted. Article - 20 Functions & Powers of the Sabha :- 1. Only the national level sabha will have the right to decide about the policies. 2. To elect the president & other office bearers as per the level of the sabha . 3. Any other resolutions which are presented to the sabha, to considered them & take necessary action on them. 4. Sabha of any level can accept of reject the decision taken by the executive committee or by the any office bearer of the sabha. Article – 21 Functions of Executive committee 1. To arrange for day to day work. 2. To call upon the sabha meeting & to manage their arrangement. 3. To do ay other work assigned by the sabha. Article – 22 Sub Rules To do the rotten functioning of the sabha, the National executive,. keeping in mind the articles of constitution, will prepare the sub-rules. All sabhas will work according to these sub-rules .No sub rule can be made which is in convention to any article of sabha constitution or violates any of the article of Sabha constitution.
Article – 23 Amendment in the Constitution Only National Sabha has right to amend the constitution. Each resulation for amendment in the constitution can be passed by the 1/3 majority of the total elected deligates of the sabha.
Article – 24 Period of the Sabha Sabha at each level will be elected for three years. The year will be counted from Ist January to 31st December.
Article – 25 Meeting of the Sabha/Delegates SESSION :- Meetings of the sabha / delegate session at each level will be as follows:-
1. After the election of the deligates of the new sabha it is essential to convene first meeting within 2 months. Beside first meeting, three meeting in three year will be compulsory but the time gap between two meetings should not be more than one year. Meeting of sabha at each level will be call by the president of that sabha according to the norms. Notice of the meeting should be given minimum 20 days before the date of meeting. 2. Meeting of the sabha will be presided over by the president & in case of his absence Senior vice-president, vice-president or any other office rarer as per seniority given in the respective articles in the constitution will preside over the meetings. 3. If 50% of the total delegates gives in writing to the president to call up the meeting then it is compulsory for the president to call up the meeting. If president fails to convene the meting within 20 days then the delegates after giving 20 days notice can, convene the meeting themselves. Article – 26 Quorum 1. To start the proceedings of the sabha of any level the presence of 1/3 delegates of the total delegates is must. But the decision will be taken with the simple majority of the total members of the sabha. 2. If the quorum is not complete the meeting can not be held & sabha can take no decision .If the quorum is not complete in the second meeting too then the decision can be taken with simple majority of the present members. 3. Quorum – Executive committee: To intiate the proceeding of the sabha at any level the 1/3 members of the total office bearers/members of the executive committee must be present in the meeting. But the decision will be taken with simple majority of the total members/office bearers. Article – 27 Meetings of the Executive committee: Meeting of the executive committee will be held under the leadership of the president. In case, the absence of president , Senior vice-president or vice-president , any other office bearer as per seniority given in article 18 will preside over the meeting . In ordinary circumstances two meetings of the executive committee must be held. But time gap between the two meetings should not be more than six month.
Article – 28 Finance Audit Year :- 1 The finance year will be from the Ist January to 31st December. 2. Bank Account :- The sabha will open its Bank Account in any scheduled bank which the executive committee of the sabha will recommend and money will be deposited in that bank. For operating the bank account the names of three office bearer i.e (president, Secretary General/General Secretary & Finance Secretary) will be given to the bank. It will be the responsibility of the president to withdraw the money from the bank, but the account will be operated by any two i.e. president & secretary general/ general secretary, president & finance secretary. Article -29 Funds :- (A) Any income to the sabha at any level will be counted as the income of the National Sabha.
(B) The total membership fees will be sent to the National sabha.
(C) Fee given by the member will be devided as under:-
1. Sabha at district level 25% 2. Sabha at State level 50% 3. Sabha at National level 25% (D) Special Collected Funds :- Request can be made by Sabha of any level to collect funds for some specific purpose. When the funds are collected for specific purpose on the appeal/instruction of the upper level sabha then the whole collected funds will go to that sabha according to the instructions.
(E) Donation :- Beside the above, if the sabha at any level gets any find of donation then the whole donation will go to national level sabha. In case of need the sabha can give financial help to the sabha at any level.
(F) Financial Help :- The sabha at lower level can ask for financial help to the upper level sabha & upper level sabha can give financial help to the lower level sabha. Sabhas of different level can give and ask for financial help to each other.
Article – 30 Expenditure Expenditure can be done as per instructions issued by the sabha. The National Sabha will issue detailed guide lines for expenditure & expenditure will be done according to the instructions.
Article – 31 Audit At each level audit will be coducted according to the policy laid done by the National Sabha In this relation National Sabha will issue detailed guide lines. For this purpose executive committee of National Sabha will form on Audit Committee. Audit Committee will audit the income & expenditure of the sabha at each level according to laid down policy & will present the audit report to the executive committee. Copies of this report will be sent to the upper sabha for appropriate action.
Article – 32 Disciplinary Action :- (A) The sabha can take disciplinary action against that member/delegate or office bearer if he/she does not abide by the norms of the sabha or disobey the norms of sabha or does any such task which defame the name of the sabha. For this purpose disciplinary committee will be formed at each level of the sabha. This disciplinary committee after investigating into the blames imposed on the member/delegate/office bearer will present the report to the concerned president. The executive committee will take appropriate action on that report.
(B) The sabha can punish the members , delegates/office bearers as under:-
1. By giving warning. 2. By removing from the post or office. 3. By recovering the lose done to the Sabha. 4. By canceling the membership, where the cancellation of membership has been recommended , in that case district president/state president will send their report with comments to the national president. only the national president has righ to take the decision of cancellation of membership. Article - 33 Appeals Appeals against the punishment referred in art :- 32 (1, 2, 3) concerned member / members can appeal as detailed below :-
1. If punishment has been awarded by the district president than appeal can be made to the State president. If punishment has been awarded by the State president then its appeal can be made to the national president. The concerned president will decide the appeal. 2. If the punishment has been awarded by the national president under Art.- 32 (4) ( cancellation of membership ) then appeal against can be made to the national executive committee. National executive committee can take decision as it thinks suitble. Note :- Here this has been clarified that this article will be separate and independent from Art.-20, meaning there by that the punishment matter will be delt under the Art.-32 and 33 . In case of pensionments Article -20 (4) will not be applicable.
Article – 34 Legal Action 1. Any legal action on the sabha or on behalf of the sabha can be inciated by its president in the name of the Goaar Rajpoot Sabha. 2. Any legal action against the sabha can be inciated at the head office of the sabha.
